Suit to stop NY recognizing gay marriages is dismissed

ALBANY – A state Supreme Court judge in the Bronx yesterday upheld Gov. David A. Paterson's order that state agencies recognize same-sex marriages performed and sanctioned elsewhere, dismissing a lawsuit asserting the governor had overstepped his authority.

Judge Lucy Billings, in a 26-page decision, said Paterson had not violated the state constitution's separation of powers clause, because his order sought only to clarify existing law, not overturn it. Gay marriage remains illegal in New York.
